Ophthalytics, Inc. ("Ophthalytics," "we," "us," or "our") is committed to respecting your privacy. This Privacy Notice ("Notice") explains how we collect, use, share, and otherwise process personal information about visitors to our marketing website, including ophthalytics.com and ophlx.com (the "Site").
What This Notice Does Not Cover
This Notice applies to the Site only. It does not apply to:
- our clinical and diagnostic platforms and products (such as Ocula360, Nsight360, 2nd Opinion, and Ophthal360), which we provide to healthcare organizations under separate agreements and privacy terms;
- patient or health information we process on behalf of healthcare providers, clinics, or health systems. If you are a patient of an organization that uses our technology, please refer to that organization's privacy notice and direct any privacy requests to them;
- de-identified or anonymized information that cannot reasonably be linked to you; or
- personal information collected in connection with employment or job applications.
Personal Information We Collect
The personal information we collect depends on how you interact with the Site and the choices you make.
Information you provide directly
When you submit a contact form, request a demo, subscribe to our newsletter, or otherwise communicate with us, we collect the information you choose to provide—which may include your name, email address, phone number, organization or employer, role, and the contents of your message.
Information collected automatically
When you visit the Site, certain technical information may be logged automatically by our hosting and security infrastructure—such as your IP address, browser type, device and operating-system information, the pages you view, the date and time of your visit, and the site you came from. We use this to operate, secure, and troubleshoot the Site.
We may also collect usage information through cookies and similar technologies, but only with your consent, as described in "Cookies and Similar Technologies" below. We do not currently use analytics, advertising, or other tracking cookies, and we do not track your browsing activity.
Information we infer
We may infer limited information from the data above—for example, your general geographic location (such as city, region, or country) from your IP address.
You can choose not to provide personal information, and you can use browser or device controls to limit certain automatic collection. If you decline information that is necessary for a feature (such as a contact form), that feature may not be available or fully functional.
Cookies and Similar Technologies
What they are
Cookies are small text files placed on your device by your browser; similar technologies include pixels, tags, and local storage. They can allow a website to recognize your browser over time.
Our approach—consent first
We currently do not use analytics, advertising, or other non-essential cookies, and we do not track your activity. If we introduce non-essential cookies in the future (for example, website analytics), we will ask for your consent first through a cookie banner or similar control. You may decline. If you do not affirmatively consent, we will not set those cookies or track your activity through them.
Strictly necessary cookies
If the Site uses any cookies that are strictly necessary for it to function or to keep it secure, those may be set without consent as permitted by law. They are not used to track you for advertising.
Your controls
- Cookie banner: where offered, you can accept or decline non-essential cookies and change your choice at any time.
- Browser settings: most browsers let you block or delete cookies. Disabling cookies may affect some features.
- Do Not Track: because there is no common standard for "Do Not Track" (DNT) browser signals, the Site does not currently respond to them—however, because we do not track you without consent, your activity is not tracked regardless.
How We Use Personal Information
- Respond to your inquiries and demo requests;
- Send communications you have requested, such as our newsletter and product updates;
- Operate, secure, maintain, and improve the Site;
- Understand how the Site is used (where analytics are enabled, with your consent);
- Send marketing communications about our products and events, from which you can opt out at any time; and
- Comply with legal obligations and protect our rights.
How We Share Personal Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share personal information only as described here:
- Service providers: vendors that perform services for us, such as website hosting, customer relationship management (CRM), email delivery, and—if enabled, with your consent—analytics. They may process personal information only on our behalf and under contract.
- Legal and safety: when we believe it is necessary to comply with applicable law or valid legal process, enforce our terms, or protect the rights, property, or safety of Ophthalytics, our users, or others.
- Business transfers: in connection with a merger, acquisition, financing, or sale of assets, consistent with this Notice.
- With your consent or at your direction.
We may also share de-identified information that cannot reasonably identify you.
Your Choices and Controls
- Access, correction, deletion: you can request to access, correct, or delete personal information we hold about you by contacting us (see "Contact Us"). We may need to verify your identity and may decline requests where permitted by law.
- Marketing communications: you can opt out of marketing emails at any time using the unsubscribe link or by contacting us. We may still send non-promotional messages, such as responses to your inquiries.

Your U.S. State Privacy Rights
Depending on where you live, U.S. state privacy laws—such as the California Consumer Privacy Act, as amended (CCPA/CPRA)—may give you rights to know or access the personal information we collect about you, to request its correction or deletion, and to opt out of the "sale" or "sharing" of personal information and certain targeted advertising. As noted above, we do not sell or share personal information as those terms are defined under these laws, and we will not discriminate against you for exercising your rights. To exercise a right, contact us as described below; we will verify your request as required by law. You may also use an authorized agent where permitted.
European, UK & Swiss Privacy Rights
If you are in the European Economic Area, the United Kingdom, or Switzerland, you may have rights under the GDPR (and UK GDPR) to access, correct, delete, restrict, or object to our processing of your personal information, and to data portability. Where we rely on consent, you may withdraw it at any time. We process personal information on lawful bases including your consent, our legitimate interests in operating and improving the Site, and compliance with legal obligations. You may lodge a complaint with your local supervisory authority, though we encourage you to contact us first.
Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Notice, comply with our legal obligations, resolve disputes, and enforce our agreements, after which we delete or de-identify it.
International Data Transfers
We are based in the United States, and the personal information we collect is stored and processed in the United States and other countries where we or our service providers operate. These countries may have data-protection laws different from your own. Where required, we use appropriate safeguards for international transfers.
Security
We take reasonable and appropriate administrative, technical, and physical measures to protect personal information against unauthorized access, use, disclosure, alteration, and destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Children's Privacy
The Site is intended for a general, professional audience and is not directed to children. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, please contact us and we will take appropriate steps to delete it.
Changes to This Notice
We may update this Notice from time to time. When we do, we will revise the "Last updated" date above and, if the changes are material, provide additional notice or obtain consent as required by law.
